What most individuals do not understand about the different types of DUI's is that there're not all felonies. If you receive a DUI then you have to determine what kind of DUI it's going to be and the best way to do that is to just hire an attorney to tell you. Another way you should be able to tell what kind of DUI it is going to be is by whether or not you injured anyone or got anybody killed because of you driving while intoxicated. This is the core reason why people receive felony DUI's and if you were fortunate enough to just get a misdemeanor DUI then you are extremely lucky.

Something you really must know about a misdemeanor DUI is that in both the first and second times you get a DUI it'll be considered a misdemeanor DUI unless somebody was injured but the 3rd time is always a felony. What lots of people don't know regarding this is why the 3rd time is automatically a felony no matter what, the reason is very simple, a felony is anything that is in anyway dangerous and being that you have just received 2 DUI's you will be marked as dangerous. As you can probably already tell, the majority of people that get 1 DUI will get 1 more but after that the DUI's tend to stop.

One thing that you must understand is without the right legal representation you will almost always get a felony and the reason is because that is exactly where judges start the process from. If you would like to get your felony downgraded to a misdemeanor then you'll need to know what to say to the judge in order for that to take place, that is why an attorney is good to have at this point. One thing that most people don't understand even if they have received a felony DUI before is that a DUI even if it is reduced to a misdemeanor is still counted as part of the three strike rule.

The last thing you need to understand is that all DUI's are really serious no matter what state you are in and now days law enforcement officers are really cracking down on people who are found driving while intoxicated. Normally for adults that are found drinking and driving they are placed in jail for a night just to get them to sober up and then they are released until the hearing. The reason why intoxicated drivers are released temporarily is simply until their court date which normally is very soon because judges don't like to have intoxicated drivers wondering around the streets or getting into even more trouble prior to their court date. Just remember that not all drunk drivers are the same and it is practically impossible to know who drinks and drives and who does not. My suggestion to you is just do whatever you can to keep yourself and your family safe and hope that everyone else is doing the exact same thing.
